Is your business structure working for you?

This joint presentation by a business lawyer and an accountant compares the various business structures commonly used by small businesses today, and explains the legal risk profile and the general tax consequences of each.  It shows the steps involved in deciding which structure is best for you i.e. sole trader, a partnership, a company or a family trust.  The first step is to:

  • Who else will be involved in the business?  What do you want them to contribute to the business and in what capacity?
  • Will your business have employees? 
  • How long do you intend the business to last for? Do you intend to on-sell it and, if so when?
  • How much risk is involved in the business and is this insurable?
  • How much flexibility do you require in the business structure?
  • How do you intend raising funding of the business?
